Terms of Use — ResponDM

Welcome to ResponDM. This document defines the rules for using the service. By creating an account, accessing, or using ResponDM, you declare that you have read, understood, and fully agree to these Terms of Use and the Privacy Policy (https://www.respondm.com/en/politica-de-privacidade).

1. Who We Are

ResponDM is an Instagram automation platform that operates exclusively via the official Meta Platforms Inc. API, established in Catalão, State of Goiás, Brazil. For the purposes of these Terms, "ResponDM," "we," or "our" refer to this operation.

2. What is ResponDM

ResponDM is an Instagram interaction automation platform that operates through the official Meta APIs. The service enables, among other features:

Sending direct messages (DMs) triggered by comments on posts and Reels;

Sending DMs triggered by incoming direct messages;

Sending DMs triggered by Story replies;

Building conversation flows (Flow) with messages, buttons, carousels, media, data collection, conditions, and actions;

Public link page (Link Bio);

Restricting sends to users who follow the linked account.

Available features may vary depending on the contracted plan.

3. Registration, Account and User Responsibility

3.1. To use ResponDM, you must create an account with true, complete, and up-to-date information.

3.2. The user must be at least 18 years old. Minors are not authorized to contract the service.

3.3. The user is solely responsible for safeguarding their access credentials and for all activity carried out in their account.

3.4. The user is responsible for the Instagram account linked to ResponDM and for all content, keywords, flows, and triggers configured.

4. Plans, Prices and Execution Limits

4.1. As of May 1, 2026, the available plans are:

Free Plan — R$ 0.00 — Reduced limit as shown in the dashboard
Start Plan — R$ 39.90/month — up to 5,000 executions/month
Creator Plan — R$ 59.90/month — up to 20,000 executions/month
Pro Plan — R$ 89.90/month — up to 100,000 executions/month
Viral Plan — R$ 119.90/month — unlimited executions

4.2. An "execution" means each individual automation trigger performed by the service (sending a DM, replying to a comment, sending within a flow, etc.), as detailed in the user dashboard.

4.3. The billing cycle starts on the plan sign-up date and renews monthly on the same date.

4.4. Upon reaching 100% of the contracted monthly limit, automations are automatically paused until the cycle renews or the user upgrades their plan. There is no automatic charge for excess executions — the user only pays more if they voluntarily choose to upgrade.

4.5. Upgrades take effect immediately, with a prorated charge for the difference. Downgrades take effect in the next billing cycle, with no refund for amounts already paid.

4.6. ResponDM may adjust prices and revise execution limits. Changes will take effect in the billing cycle following notice, communicated by email and/or in the user dashboard. The user may cancel without cost if they do not agree with the adjustment.

5. Pre-Contractual Information

5.1. Before contracting any paid plan, ResponDM prominently displays:

The exact monthly price of the plan;

The billing frequency (monthly);

The chosen payment method (recurring card or one-time Pix);

The information that, for card payments, the charge renews automatically each cycle;

How to cancel the subscription.

5.2. By confirming payment, the user declares they have read this information.

6. Payment Methods and Renewal

6.1. Credit, debit, or prepaid card: billing is recurring and automatically renewed each cycle until the user cancels.

6.2. One-time Pix: billing is cycle-by-cycle. To end the subscription, simply do not make the next payment. No automatic charge will be generated by Pix.

7. Cancellation

7.1. Card: cancellation is self-service through the dashboard, via: hamburger menu > My Accounts > select account > Settings > Payments > Cancel subscription.

7.2. Pix: the subscription ends automatically at the end of the paid cycle if the user does not make the next renewal payment.

7.3. In both cases, the user retains access to the paid plan until the end of the already-paid cycle. After that, the account is automatically moved to the permanent Free plan, and the user may continue using ResponDM with Free plan limitations for as long as they wish.

7.4. The account remains active on the Free plan until the user expressly requests deletion. Account deletion permanently terminates the relationship and triggers the data deletion procedure pursuant to the Privacy Policy.

8. Refund Policy

8.1. ResponDM offers a permanent Free plan so users can try the platform before contracting any paid plan. By contracting a paid plan, the user has already had the opportunity to experience and evaluate the service for free.

8.2. The service is activated immediately upon payment confirmation. Any automation execution, Instagram account connection, or use of paid plan features constitutes the start of service delivery.

8.3. A full refund will be granted exceptionally under the following cumulative conditions:

(a) request made within 7 (seven) calendar days of payment confirmation;

(b) no automation execution has occurred in the account during that period;

(c) no Instagram account has been linked and used to send messages or flows during that period.

8.4. Outside these conditions, there is no right to a refund of amounts already paid. The user is guaranteed:

Continued use of the paid plan until the end of the already-paid cycle;

Migration to the permanent Free plan after the cycle ends;

Cancellation of renewal at any time without penalty or additional cost.

8.5. In the event of suspension for violation of these Terms (clause 9), the user forfeits the full amount paid in the cycle, with no right to refund or credit.

9. Compliance with Meta and Instagram Policies

9.1. ResponDM operates through the official Meta APIs. By using the service, the user declares awareness and agrees to comply with:

(a) Instagram's Terms of Use;

(b) Meta's Platform Terms;

(c) Messenger Platform Policies;

(d) Instagram Community Guidelines.

9.2. It is expressly prohibited to use ResponDM for:

(a) sending spam, deceptive content, pyramid schemes, or abusive multi-level marketing;

(b) distributing adult, violent, discriminatory, illegal content, or content that violates third-party rights;

(c) promoting products or services prohibited by Meta's policies (prescription drugs, weapons, unauthorized gambling, unregistered crypto assets, among others);

(d) circumventing the 24-hour Messenger API message window, sending promotional messages outside approved templates, or bypassing the platform's technical limits;

(e) harvesting data from followers or third parties for purposes unrelated to the contracted automation;

(f) any practice that may jeopardize ResponDM's integration with Meta's APIs.

9.3. ResponDM reserves the right to suspend, block, or terminate at any time and without prior notice accounts that violate this clause or that, at ResponDM's technical discretion, pose a risk to service stability, the integrity of the Meta integration, or the experience of other users.

9.4. The suspension provided in item 9.3 does not entitle the user to a refund (clause 8.5).

9.5. The user is solely responsible for ensuring that content sent through their automations complies with Brazilian law, in particular the General Data Protection Law (Lei 13.709/2018), the Consumer Protection Code (Lei 8.078/1990), and other applicable direct marketing regulations.

10. Third-Party Content and Removal (Notice and Takedown)

10.1. ResponDM allows users to upload media (images, audio, videos) and text for use in their automations. This content is the sole responsibility of the user who submits it.

10.2. If third parties identify content in automations operated by ResponDM users that violates copyright, trademark, image rights, honor, privacy, or any other right, they may request review and removal by emailing contato@respondm.com, providing:

(a) full identification of the requester;

(b) description of the disputed content and the automation/account involved;

(c) grounds for the alleged rights violation;

(d) declaration of truthfulness of the information provided.

10.3. ResponDM will review the request within a reasonable timeframe and, upon identifying a violation, will remove the content and notify the responsible user, without prejudice to the application of other sanctions provided in these Terms.

10.4. Under art. 19 of the Brazilian Internet Civil Framework (Lei 12.965/2014), ResponDM shall only be held liable for third-party content if it fails to comply with a specific court order for removal.

11. Data Ownership

11.1. Data generated by the user and their followers/leads in their use of ResponDM (captured comments, collected leads, tags, lists, configured flows, CSV exports) belongs to the user.

11.2. ResponDM acts as a data processor, as defined in art. 5, VII, of the LGPD, processing such data exclusively in accordance with the user's instructions and for the purpose of the contracted automation.

11.3. The user, as controller, is responsible for ensuring the appropriate legal bases for processing this data in relation to their followers and leads.

12. ResponDM's Intellectual Property

12.1. The brand, logo, name "ResponDM," source code, platform design, texts, manuals, and other visual and technical elements of the service are the exclusive property of ResponDM and are protected by Brazilian and international intellectual property laws.

12.2. Reproduction, modification, reverse engineering, distribution, or commercial use of these elements without prior written authorization is prohibited.

13. Service Availability and Limitation of Liability

13.1. ResponDM will use best efforts to keep the service available and functional, but does not guarantee uninterrupted, error-free, or fault-free availability.

13.2. The application depends on Meta/Instagram APIs, over which ResponDM has no control. Changes, instability, suspensions, or discontinuation of these APIs may partially or fully impact the service, without constituting a contractual breach by ResponDM.

13.3. ResponDM is not liable for:

(a) interruptions or failures arising from Meta's APIs;

(b) suspensions or bans applied by Instagram to linked accounts due to misuse or platform policies;

(c) loss of leads, conversions, or revenue resulting from technical instability;

(d) actions or omissions by the user or third parties over which ResponDM has no control.

14. Changes to These Terms

14.1. ResponDM may modify these Terms at any time, with notice by email and in the user dashboard. Changes take effect from the date of notice.

14.2. Continued use of the service after notice constitutes tacit acceptance of the new version. Users who do not agree may cancel their subscription pursuant to clause 7.

15. Acceptance of These Terms

15.1. Use of ResponDM — including creating an account, contracting a paid plan, connecting an Instagram account, or any other interaction with the service — constitutes full acceptance of these Terms, regardless of a specific signature or acceptance checkbox.

16. Jurisdiction

16.1. These Terms are governed by Brazilian law.

16.2. The courts of Catalão, State of Goiás, are elected as the exclusive venue for disputes arising from these Terms, with waiver of any other jurisdiction, however privileged.
